Pact — Terms of Service

These terms are an agreement between you and Alex Popa (individual developer, Romania, EU) — "we", "us" — covering the Pact website and mobile app ("Pact"). By creating an account you accept them. If you do not agree, do not use Pact.

1. Your account

You must be at least 16 years old. Give accurate information, keep your password to yourself, and you are responsible for what happens under your account. Tell us at support@pact-habit.com if you suspect someone else has access.

2. Licence to use Pact

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Pact on devices you own or control, for your own non-commercial use. You may not copy, resell, rent, reverse-engineer, decompile, or attempt to extract the source code of Pact, except where that restriction is prohibited by law. We keep all intellectual property rights in Pact; you keep all rights in the content you enter.

3. Accountability partners and friends — your responsibility

Pact can send WhatsApp messages about your missed habits to people you nominate. Only add someone as a partner if they have agreed to it. You confirm you have their permission to enter their name and phone number. Do not use Pact to harass anyone or to send unwanted messages, and do not enter another person's data without a lawful reason.

Friends you connect with see only aggregate progress numbers, as described in our Privacy Policy. If you turn on a public profile, you are choosing to make that aggregate card visible to anyone holding your link.

Do not break the law with Pact, interfere with or overload our infrastructure, try to access other people's data, or use automated means to scrape the service. We may suspend or terminate accounts that do.

6. Availability, and what Pact is not

We work to keep Pact running but do not guarantee it will be uninterrupted or error-free, and we may change or discontinue features. Pact is a self-improvement tool. It is not medical, psychological, or health advice, and must not be relied on as such. If you are struggling with your health or wellbeing, speak to a qualified professional.

Pact is provided "as is" to the fullest extent permitted by law. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under applicable law. Where liability can be limited, our total liability to you is capped at the greater of the amount you paid us in the 12 months before the claim, or €50.

7. Ending the agreement

You can stop at any time by deleting your account in the app (Account → Delete account), which erases your data immediately. We may suspend or end your access if you materially breach these terms; where reasonable we will warn you first.

8. Governing law and disputes

These terms are governed by Romanian law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may always bring proceedings before the courts of your own country. We may bring claims against you only in the courts of your country of residence.

We would rather fix things than argue: email support@pact-habit.com first and we will try to resolve it directly. EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

9. Apple-specific terms

Where you obtained Pact from the App Store, you acknowledge: these terms are between you and us, not Apple; Apple has no obligation to provide support for Pact; Apple is not responsible for any product warranties or for addressing any claims relating to Pact (including product liability, legal compliance, or intellectual property claims); and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Changes

We may update these terms; we will change the date above and tell you in the app if the change materially affects you. Continuing to use Pact after that means you accept the updated terms.
